Senior Director of Actis embroiled in defamation case u/s 499, read with Section 500 of the IPC

The Addl Chief Metropolitan Magistrate, Dadar, Mumbai has passed an Order, against Mr Ganapati Rathinam, Senior Director, Actis (Global PE Fund), for an offence punishable under Section 500 of the Indian Penal Code, on 17 Jun 2017.

 Accordingly the Court has issued Summons against Mr Rathinam for having committed such serious criminal offence of defamation against an ex Senior Official of Supermax Group of Companies. 

The Order has been passed based on the complaint filed by Mr Subhash Chaudhuri, ex Vice President (Operations & Corporate Affairs) of Supermax Group of Companies, as well as the ex- Managing Director of one of the overseas Units of Supermax Group of Companies.  The said accused Mr G Rathinam, is a Senior Director of Actis, which is a key shareholder in the Supermax Group of Companies.

As per the complainant, the accused should have refrained from making such highly defamatory remarks against him, since he had been working in a professional capacity and taking strategic decision, keeping in mind, the overall interest of the company as well as protecting the shareholder value and not to succumb to the pressures of lust and greed of individual Directors of Actis, who had a personal  and hidden agenda of profiteering  out of the sale of prime land which are being used for manufacturing operations and providing jobs to several thousands of people of local populace.

In his Order, dated 17 Jun 2017, SJ Biyani, Addl Chief Metropolitan Magistrate, V Court, Dadar, Mumbai, considering the submissions of the complainant and evidence adduced in the complaint, the complainant has made out a prima facie case against the accused Mr Ganapati Rathinam, for offence, punishable under Section 500 of the Indian Penal Code.

Accordingly he has passed an Order against Mr Ganapati Rathinam, and issued Summons, for having committed offence, punishable u/s 500 of the IPC.
